CafeCommand Terms & Conditions

1. Acceptance of Terms
By accessing, browsing, purchasing, or using CafeCommand ("Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these Terms, you may not use the Service.
2. Description of Service
CafeCommand provides restaurant operators with operational monitoring, reporting, alerting, and related support services designed to assist with reviewing labor, sales, staffing, compliance, and other operational metrics.
CafeCommand is an informational and decision-support tool only and does not replace management oversight, business judgment, legal compliance obligations, or operational decision-making.
3. Eligibility
You represent that you have the authority to enter into this agreement on behalf of yourself or the business you represent.
4. Account Access and Authorization
You are responsible for ensuring that CafeCommand has proper authorization to access any reports, emails, data feeds, or operational information necessary to provide services.
You represent that you have the legal right and authority to provide such access and information.
5. Fees and Billing
Setup fees are due prior to onboarding and configuration.
Recurring subscription fees are billed in advance according to the selected service plan.
Failure to pay invoices when due may result in suspension or termination of service.
CafeCommand reserves the right to modify pricing upon reasonable notice to existing customers.
6. No Refund Policy
All setup fees are non-refundable.
Monthly subscription fees are non-refundable once billed.
Because onboarding, customization, configuration, and support resources are allocated immediately upon purchase, CafeCommand does not provide refunds, credits, or prorated reimbursements except where required by law.
7. Client Responsibilities
Clients are solely responsible for:
Reviewing all alerts and reports
Making staffing decisions
Managing labor costs
Ensuring legal and regulatory compliance
Verifying the accuracy of business data
Supervising employees and business operations
CafeCommand does not make operational decisions on behalf of clients.
8. Service Availability
CafeCommand strives to provide reliable service but does not guarantee uninterrupted operation.
Services may be affected by:
Internet outages
Email delivery failures
SMS delivery failures
Third-party software interruptions
Scheduled maintenance
Technical issues outside CafeCommand's control
Temporary interruptions shall not constitute a breach of these Terms.
9. No Guarantee of Results
CafeCommand does not guarantee:
Increased profits
Reduced labor costs
Increased sales
Improved compliance
Improved operational performance
Prevention of losses
Business outcomes depend on numerous factors outside the control of CafeCommand.
10. Third-Party Services
CafeCommand may utilize third-party providers including:
Email providers
SMS providers
Cloud hosting providers
Artificial intelligence providers
Analytics providers
Reporting systems
CafeCommand is not responsible for errors, delays, interruptions, inaccuracies, or outages caused by third-party services.
11. Limitation of Liability
To the fullest extent permitted by law, CafeCommand and its owners, employees, contractors, affiliates, and representatives shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages.
This includes but is not limited to:
Lost profits
Lost revenue
Lost business opportunities
Staffing decisions
Payroll expenses
Data inaccuracies
Service interruptions
In all cases, CafeCommand's total liability shall not exceed the total amount paid by the client during the three (3) months immediately preceding the event giving rise to the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless CafeCommand and its affiliates from any claims, damages, liabilities, costs, and expenses arising from:
Your use of the Service
Your business operations
Your violation of these Terms
Unauthorized access provided by you
Information submitted by you
13. Intellectual Property
All software, workflows, content, designs, methodologies, automation systems, branding, documentation, and related materials provided by CafeCommand remain the exclusive property of CafeCommand.
No ownership rights are transferred to customers.
14. Termination
Either party may terminate service at any time.
CafeCommand may suspend or terminate services immediately for:
Nonpayment
Fraudulent activity
Unauthorized access attempts
Abuse of the Service
Violations of these Terms
Upon termination, all outstanding balances remain due.
15. Modifications
CafeCommand may update these Terms & Conditions at any time.
Updated versions become effective upon posting to the CafeCommand website.
Continued use of the Service constitutes acceptance of revised Terms.
16. Governing Law
These Terms shall be governed by the laws of the State of New Hampshire without regard to conflict of law principles.
Any dispute arising under these Terms shall be brought exclusively in a court of competent jurisdiction located within New Hampshire.
